Privacy Policy

Our commitment is to protect the personal information of our clients and visitors, strictly complying with regulations in LATAM, USA, Canada, and the EU (GDPR).

Last updated: November 20, 2025

1. Introduction and Global Legal Scope

This Privacy Policy describes how StatMark Research Corp. and its affiliates (hereinafter, "StatMark", "we", "us", or "our") collect, use, disclose, and protect your personal information. This applies to our main website (statmarkresearch.net) and our market research services in Latin America (LATAM), the United States (USA), Canada, and Europe.

Data Controller: StatMark acts as the Data Controller for the information of our clients, prospects, and website visitors.

Regulation and Compliance: We are committed to complying with applicable data protection regulations in our operating jurisdictions, including the General Data Protection Regulation (GDPR) of the European Union, the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada, the LGPD of Brazil, Mexico's LFPDPPP, and US privacy laws (such as CCPA/CPRA, where applicable).

Acceptance: By using our website or interacting with our contact forms, you accept the practices described in this Policy.

2. Types of Information Collected

2.1. Client and Prospect Information (Direct)

We collect data you provide directly when requesting information, services, or subscribing. This includes: full name, corporate email, phone number, job title/position, and company name. This data is necessary to manage the business relationship and respond to your requests.

2.2. Browsing Information (Automatic)

We automatically collect information for analytical purposes regarding how you interact with our website. This includes: IP address, general geolocation data (country/city), device and browser type, pages visited, and time spent on the site.

2.3. Panel and Survey Data (Indirect)

As a market research firm, we may occasionally receive personal data of study participants via third parties (panel providers). In such cases, StatMark acts primarily as a Data Processor, governed by strict agreements and Section 4 of this policy.

3. Use, Legal Basis, and Purpose

The legal basis for processing your data is based on Consent (when subscribing), Legitimate Interest (to improve our services), or Contractual Necessity (when formalizing a service with you or your company).

Main purposes include:

  • Commercial and Contractual Management: Responding to inquiries, sending proposals, and managing service contracts.
  • Operational Improvement: Analyzing website usage trends to optimize the platform.
  • Communications: Sending newsletters or service information if you have provided consent.
  • Market Research (Anonymization): Processing survey data to generate insights for our clients (see Section 4).
  • Legal Compliance and Security: Preventing fraud, protecting our rights, and complying with legal requirements.

4. Data Processing in Surveys (Anonymization and Aggregation)

Information anonymization is the fundamental principle of our market studies.

As researchers, any personal information collected during a study (e.g., name, email, phone) is immediately dissociated or pseudonymized for analysis. Results delivered to our clients are always aggregated and statistical, ensuring no individual identification of any respondent.

Exception (Qualitative Studies): If a qualitative study (e.g., in-depth interviews, focus groups) requires the use of personal data (e.g., video, audio, or contact info) for recruitment or validation, separate Explicit Consent will be requested from the participant.

5. Cookies and Tracking Technologies

We use cookies and similar technologies for three main purposes:

  • Essential/Technical Cookies: Necessary for basic website functionality.
  • Performance/Analytical Cookies: To measure traffic and performance (e.g., Google Analytics). These only activate if you provide consent.
  • Preference Cookies: To remember your settings (e.g., language).

Cookie Control: You have the right to accept or reject non-essential cookies via your browser settings or our consent banner. For EU/EEA and Canadian users, explicit consent is managed before installing non-essential cookies.

6. Data Sharing and International Transfers

StatMark DOES NOT sell, rent, or trade personal information to third parties for direct marketing purposes.

  • Service Providers (Processors): Partners who help us operate (e.g., hosting, email systems).
  • Corporate Affiliates: Within the StatMark group for administrative management.
  • International Transfers (GDPR): For transfers outside the EU/EEA, we use approved mechanisms like Standard Contractual Clauses (SCC).

7. Data Subject Rights (GDPR, ARCO, PIPEDA)

You have rights over your information. StatMark is committed to facilitating these rights (Access, Rectification, Deletion/Right to be Forgotten, Opposition, Portability, and Withdrawal of Consent).

To exercise these rights, please contact our Data Protection Officer (DPO) using the info in Section 9.

8. Security and Data Retention

We implement industry-leading technical and organizational security measures, including SSL encryption, advanced firewalls, and rigorous access controls.

Retention: We retain personal information only as long as necessary to fulfill the purposes for which it was collected, including legal or accounting requirements.
